Abstract

This paper examines the international legal regulation of cross-border data flows in digital trade, focusing on the fragmented nature of the current global regulatory framework and its core controversies. By analyzing provisions in key free trade agreements (FTAs), the study highlights the role of the "principle + exception" model in reconciling tensions between trade liberalization and data sovereignty. It further explores the governance logic of regional frameworks and their implications for global rules. The research identifies three distinct governance models: the U.S. prioritizes free data flow, the EU emphasizes human rights protection, and China balances security with development. Conflicts among these models complicate international coordination. The paper argues that China should construct a new global digital governance paradigm by refining domestic legislation, aligning with high-standard international rules, and conducting regional innovation experiments.
