Abstract

In this research, the researcher will tell about the phenomenon of online transportation that is currently sweeping the world which in turn has led to the legal need to regulate this online transportation. Indonesia as a country with a population of nearly 260 million is a potential market to use the online transportation application. However, the Indonesian Government has not made maximum efforts to regulate this online transportation so that this has resulted in many online transport drivers filing claims to the Constitutional Court to submit applications for review traffic laws and road transport. In this study, researchers sought to find solutions related to the problem of online transportation in Indonesia so that the Indonesian people, especially drivers of online transportation or consumers of online transportation, are protected by law and constitution so that online transportation can be accepted as viable and safe transportation for Indonesian people.
